Legality of CBD
The 2018 Farm Bill removed schedule I status from hemp and its derivatives under the Controlled Substance Act of 1970. This means that the cultivation, production and sale of Hemp and Hemp-derived products are federally legal.
Hemp and Marijuana are both Cannabis plants. The difference is that Hemp plants contain <0.3% of THC (tetrahydrocannabinol), the psychoactive substance found in marijuana. Hemp is federally legal while Marijuana is federally illegal.
The approved legality of industrial hemp also allows for hemp-derived products (including CBD oil) to be federally legal due to their nonintoxicating levels of THC. However, individual states can still decide if they want to allow hemp-based products to be sold within state borders.
